Terms of Service

Draft, 1 November 2026

1. Who we are

Lifetree Email (“we”) is operated by [legal entity, registered address]. These terms govern your use of lifetree.email, the console, the API, the SDK and the MCP connector (the “Service”). By creating an account you agree to them. If you use the Service for an organization, you confirm you may bind it.

2. What the Service does

The Service sends email you give it, from domains you have proved you control, through Amazon Simple Email Service (SES). It queues messages, handles bounces and complaints, and reports status.

Our service objective is to hand a message on the standard lane to SES within 7 minutes of accepting it, and to aim for 60 seconds on the express lane. Those times end when SES accepts the message. We do not promise that a message reaches an inbox, or when: that depends on the receiving server. We measure and show what we can. [Whether any credit applies when the objective is missed is to be decided.]

3. Your account

Keep your sign-in, passkeys and API keys safe; you are responsible for what is done with them. A key shown once cannot be shown again. Tell us at once at security@lifetree.email if you think one has leaked. You must give an address you can receive mail at, and be at least 18 years old.

4. Your domains and your mail

You may only add domains you control. A domain can belong to one account. You are the sender of the mail you send, and responsible for its content and for having the right to send it. For personal data you send through us, you are the controller and we are your processor; see the Privacy Policy.

5. Acceptable use

Your use must follow the Acceptable Use Policy, which is part of these terms. It bans spam and purchased lists.

6. Trial and sandbox

The trial is free, sends up to 100 credits a day, and only reaches addresses that have confirmed they agree. We may change or end the trial.

7. Credits, payment and refunds

Plans and top-ups are prepaid and sold through Link, by Stripe, which is the merchant of record for these sales: it calculates and collects any sales tax, VAT or GST, sends receipts and invoices, and handles payment support and disputes. Your statement shows LINK.COM. Credits measure use: one per recipient on the standard and batch lanes, three on express, and more for attachments over 1 MB, as shown in the console. When credits run out, sending stops. There are no overage charges.

Plan credits are for the billing period [unused plan credits roll over: to be decided]. Top-up credits last 12 months. Credits are returned for messages you cancel in time and for messages SES permanently refuses through no fault of the content. Bounces and complaints are not refunded. Subscriptions renew until cancelled in the billing portal; cancelling moves you to the trial at the end of the period. Fees are non-refundable except where the law requires. Prices may change on 30 days' notice.

8. Suspension

We protect shared sending infrastructure. We may pause sending automatically or by hand if your bounce rate reaches 4%, your complaint rate reaches 0.08%, you breach these terms, or we reasonably see a risk to the Service, its users or recipients. We will tell you why and review it with you. Limits such as warming, daily caps and rate limits apply to all accounts.

9. Ending

You may stop at any time. We may end these terms on 30 days' notice, or at once for a serious breach. Afterwards we keep and delete data as the Privacy Policy describes. A released domain name is held back for 30 days. Sections that by their nature should survive will survive.

10. Warranties

The Service is provided “as is” to the extent the law allows. We do not warrant uninterrupted operation or inbox placement.

11. Liability

To the extent the law allows, neither side is liable for indirect or consequential loss, or for lost profits or data, and our total liability in any 12 months is limited to what you paid us in those 12 months. [Cap and carve-outs for review.] Nothing limits liability that cannot be limited by law.

12. Indemnity

You will defend us against third-party claims arising from the content of your mail or your breach of the Acceptable Use Policy.

13. Changes

We may change these terms and will give at least 30 days' notice of material changes by email or in the console. Continuing to use the Service after that means you accept them.

14. Law and disputes

[Governing law and venue to be decided.]
